Salkovitz violated the Massachusetts Wage Act, G.L. c. 149, § 148, by failing to timely pay all Massachusetts-based CTS employees the wages they earned during their final pay period, their accrued and unused vacation time and the additional compensation promised to Massachusetts-based CTS store-level employees (termed a so-called “retention bonus”); 2) that the Defendants were unjustly enriched as a result of their failure to timely pay all Massachusetts-based CTS employees the wages they earned during their final pay period and the additional compensation promised to Massachusetts-based CTS store-level employees (i.e., the “retention bonus”); and 3) that the Defendants negligently misrepresented that they would pay all Massachusetts-based CTS employees the wages they earned during their final pay period, and as to Massachusetts store-level employees, the “retention bonus” in consideration for continuing to work through the close of the liquidation/going out of business sale.
